Terms and Conditions of Use
1.0 Acceptance of Terms. Donruss Playoff L.P. and Score Entertainment (collectively, “Score
Entertainment”) provides this service to you, subject to the following
terms and conditions, which may be updated by us from time to time without
notice to you. You are responsible for regularly reviewing these terms, conditions
and notices, and any additional terms posted on this web site. Your continued
use of this web site after the effective date of such changes constitutes your
acceptance of and agreement of such changes.
2.0 Purpose. The purpose of this Agreement is to state the terms and conditions
under which Score Entertainment provides this forum and the terms and conditions
that you agree to follow in exchange for the service provided (collectively, “Terms
and Conditions”).
3.0 Termination. You agree that Score Entertainment may terminate this Agreement
at any time without prior written notice to you. Score Entertainment will not
be liable for damages of any kind solely as a result of exercising its right
to terminate. Upon notice of termination, your User ID will be deleted and
you will be prohibited from participating in the forum.
4.0 Forum Rules. You agree to abide by the rules and guidelines set out in
the Forum Rules that are included below, as well as any future modification
to the Forum Rules that may be made without notice to you.
5.0 Agency Relationship. You acknowledge that you are not an agent or representative
of Score Entertainment and that the other users of the forum are not agents
or representatives of Score Entertainment.
6.0 Participant Actions. All Hosts, Judges, Players, and On-Line Users participating
in any SEVEN sanctioned event or on-line forum are acting on their
own behalf, and they have no authority to speak or act on behalf of Score Entertainment.
Score Entertainment does not approve, consent or endorse any action by a Host,
Judge, Player or On-Line User in connection with a SEVEN sanctioned
event or on-line forum.
7.0 Indemnification. Score Entertainment and Donruss Playoff L.P., including
their present or former affiliates, officers, directors, shareholders, employees,
insurers, agents and representatives (collectively, “Indemnitees”),
shall not be liable or responsible for, and shall be saved and held harmless
by Host from and against any and all suits, actions, losses, damages, claims,
or liability of any character, type, or description, including all expenses
of litigation, court costs, and attorney’s fees for injury or death to
any person, or injury to any property, received or sustained by any person
or persons or property, arising out of, or occasioned by, directly or indirectly,
your participation in this on-line forum, including claims and damages arising
in whole or in part from the negligence of Indemnitees .
It is the expressed intent of the parties to this Agreement that the indemnity
provided for in this section is an indemnity extended by you to indemnify
and protect Indemnitees from the consequences of Indemnitees’ own negligence,
whether that negligence is the sole or contributory cause of the resultant
injury, death, or damage.
8.0 Limitation of Liability. You agree that Score Entertainment, Donruss
Playoff L.P. and their subsidiaries, affiliates, officers, agents or other
partners and employees, shall not be liable to applicant for any injury, including
any special, incidental or consequential damages, to you or your property,
arising out of, or occasioned by, directly or indirectly, the failure or defectiveness
of any service furnished by Score Entertainment pursuant to this Agreement.
These limitations apply to all causes of action in the aggregate, including
without limitation, breach of contract, negligence, misrepresentation and other
torts.
9.0 Entire Agreement. This Agreement constitutes the entire understanding
and agreement between you and Score Entertainment (collectively, “Parties”)
as to the matters set forth herein.
10.0 Arbitration. Any controversy or claim arising out of or relating to
this contract, or the breach thereof, shall be settled by arbitration administered
by the American Arbitration Association in accordance with its Commercial Arbitration
Rules, and judgment on the award rendered by the arbitrator(s) may be entered
in any court having jurisdiction thereof. Any arbitration proceedings shall
be held in Tarrant County, Texas.
11.0 Governing Law. Notwithstanding Section 10.0, t his Agreement will be
governed by and construed in accordance with the laws of the State of Texas
without regard to its rules on choice of law.
12.0 Venue and Forum Selection. The Parties agree that this agreement is
performable in Tarrant County, Texas and any and all disputes arising out of
this Agreement shall be brought exclusively in a court of competent jurisdiction
in Tarrant County, Texas.
13.0 Notice. Any notice required by or pursuant to this Agreement shall be
by certified mail, return receipt requested, and shall be deemed received three
(3) days after mailing. If to Score Entertainment, notice shall be sent to
Score Entertainment, Attn: Community Host, 2300 East Randol Mill Road, Arlington,
Texas 76011. If to you, notice should provided by either e-mail or postings
on the forum.
Forum Rules
The reason these boards were created was to give fans and players a place
to discuss the game and the TV series. This includes, but is not limited to;
card talk, tournaments, the TV show and characters, dream cards, deck strategies,
and finding opponents. Score Entertainment also encourages communities to form
groups and conduct these types of discussions. Score Entertainment promotes
respect and an overall sensitivity to all its members and does not condone
the use of its boards as an arena for people to voice opinions outside of the
general board theme. People of every age visit these message boards, and as
such, each User’s conduct should reflect this all-inclusive environment.
You agree to abide by Inuyasha TCG Official Message Board rules, including:
1) Profanity, in any form, is not allowed.
A) Self-censoring (such as with asterisks) is still considered profanity.
B) Any attempt to override the censors on profanity through the use of spacing,
symbols, white text, or any other means is not allowed. This does not apply
to words that are really innocent but happen to have the word inside, such
as "pass." Misuse of this exception, just to put in profanity, is
still considered profanity.
2) Spam is not allowed.
A) Topics must be open for discussion, or at least be a strong enough statement
that it is very likely that people will respond.
B) All topics must have some kind of point to them beyond basic things. "Inuyasha's
cool," for example, is unacceptable. However, it is acceptable to make
the topic around "What has Inuyasha done to be so cool?"
C) Advertising is a topic not open for discussion, and it is considered spam.
D) Do not post the same message in multiple forums. That's considered “flooding” and
is another form of spam. Unless all of them are actually different, a surge
of new topics suddenly by a member is flooding.
E) Topics must stay on the subject originally intended. For example, don't
start by talking about Inuyasha and then later on change the topic to "I can
make great pancakes."
F) This message board is meant for everyone to talk, not just two people.
No discussions directed at specific individuals are allowed.
G) Unless the topic actually involves a huge word, do not make any word or
string of letters/symbols that is so large it stretches the screen.
H) If you have a post that gets edited often, remove the blank lines that
appear on the bottom after the first edit.
I) If you are the last one to post in a topic, do not post again. If you
have something new to say, edit your last post instead.
J) Do not post simply to bring a topic up in the list (otherwise known as “bumping”).
3) You may not provoke, exclude, or otherwise negatively target other users
or groups through topics or comments.
A) Rude behavior will not be tolerated.
B) Inflammatory topics include, but are not limited to, religious beliefs,
political viewpoints, and other controversial topics.
4) Signatures must adhere to the rest of the rules (with the exception of
advertising) and may be up to 4 lines and may not contain more than 255 characters
as viewed on an 800 x 600 monitor resolution.
5) No images are allowed.
6) No trading is allowed.
7) Discussions of how good a trade was/could be are allowed, because it is
not actually trying to trade with board members.
8) Anything that is done solely for the purpose of attracting traders and/or
negotiating trades with board members is forbidden.
9) Nothing of sexual content is allowed. This includes, but not limited to,
sexual preferences or relationship questions.
Privacy Statement
Donruss Playoff L.P. is committed to protecting your and your family’s
privacy on the Internet on our web sites. It is the intention of Donruss Playoff
L.P. to be in compliance with COPPA (the Children's Online Privacy Protection
Act) by the Federal Trade Commission. Should you wish to learn more about this,
please visit www.ftc.gov.
Parental Consent Donruss Playoff L.P. requires parental consent in order
to be registered for any reason on our site. Upon entering an area requiring
a site registration, those under the age of 13 will be required to have a parent
or legal guardian sign a form that must be faxed in to the fax number or mailed
in to the address at the bottom of this statement. No child will be allowed
to have his/her personal information (including their possible username) stored
in our web site’s database. Upon receipt of a completed document, Donruss
Playoff L.P. further reserves the right to verify that an actual adult signed
the document by making a follow-up phone call to the listed parent or legal
guardian. Once the document has been received and information has been verified,
if necessary, the child’s information will be added to our web site’s
database and an e-mail with the account password will be sent to the child’s
e-mail address. Once a site visitor is registered, he/she will be able to enter
online contests, participate in the Rewards and online redemption offers, and
receive e-mail newsletters. Registrants may opt out of the e-mail newsletters
at any time by following the removal directions in the e-mails.
Information Collection Donruss Playoff L.P. will collect information through
the use of the registration forms, as well as through Cookies that customize
the presentation of the site to each individual visitor. These files are stored
on the individual computer of the site visitor. We ask registered users for
their name, address, date of birth, e-mail address and offer an opt-out subscription
to our e-mail newsletter. Score Entertainment only collects the information
necessary to allow visitors to participate in online redemptions, contests,
e-mail newsletters, or other features of the site.
Information Usage Donruss Playoff L.P. will use the information from the
registration process to send out e-mail newsletters, notify contest winners,
and to send out properly redeemed trading cards fulfilled through an online
redemption process. We also use the information for marketing purposes so that
we can deliver cards at our usual high standards – and what you, our
customers, want. Donruss Playoff L.P. will not sell any information to any
third parties. Further, no registration information is given to any third parties,
except in the cases of some contests. When stated in the Official Rules of
the contest, the contest participants’ registration information may be
given to a third party. The Official Rules of each contest would delineate
the organization(s) that would receive the information. Parents are advised
to visit the web sites of those companies before registering for any such contest.
Site registration will not automatically enter any visitor into a contest.
However, in order to enter any web site contests, site registration is required.
Registration Update & Removal An account may be updated at any time by
logging in and changing the e-mail address or other information in the section
titled “Preferences.” Those wishing to be removed from an e-mail
newsletter list may do so by following the removal directions found at the
bottom of an e-mail newsletter. Parents wishing to view their child's personal
information submitted to this web site may also log in to the account or may
contact Donruss Playoff L.P.’s web master, either by e-mail, U.S. Mail,
or phone. In the message requesting the web site data, please include the name
of the child and the child's e-mail address. Please also include contact information
of the parent, either mailing address or phone number, so that the child's
information can be disclosed to the parent. Should a parent wish to have his/her
child removed from the web site's database, the parent may again use any of
the following methods to contact Donruss Playoff L.P.

PLAYER AGREEMENT
This Agreement is subject to the terms and conditions
on the following pages.
Terms and Conditions
1.0 Purpose. The purpose of this Agreement is to state the terms and conditions
related to your participation as a Player in the SEVEN community
.
2.0 Term. The initial term (“Initial Term”) of this Agreement
shall commence on the date on which you return a completed Agreement to a Host
or Judge at a SEVEN approved event and shall continue for one year.
Thereafter, this Agreement shall automatically renew for successive one (1)
year terms (each a “Renewal Term”), unless either party notifies
the other, at least thirty (30) days prior to the end of the Initial Term,
or then-current Renewal Term, as the case may be, of the notifying party’s
election not to renew this Agreement, whereupon this Agreement shall terminate
on the last day of the Initial Term or the then-current Renewal Term, as the
case may be.
3.0 Termination. Donruss Playoff L.P. and Score Entertainment (collectively, “Score
Entertainment”), may terminate this Agreement at any time without prior
written notice to you. Score Entertainment will not be liable for damages of
any kind as a result of exercising its right to terminate this agreement. Upon
notice of termination, you will be prohibited from participating in any SEVEN sponsored
or approved event.
4.0 Representations and Warranties. You hereby represent, warrant and covenant
to Score Entertainment as follows:
4.1 You have read and understand the SEVEN General Rules, the SEVEN Event
Manual, the SEVEN Code of Conduct, the individual game rulebooks,
the Current Rulings Document and the Advanced Ruling Document (collectively,
the “SEVEN Manuals”) available on the Score Entertainment
website or the applicable game's website at the time you signed this Agreement.
4.2 You will abide by the rules and guidelines set out in the SEVEN Manuals.
You recognize that the SEVEN Manuals are updated periodically and
you agree to abide by the rules and guidelines set out in the most recent version
of the SEVEN Manuals available on the Score Entertainment website
or the applicable game’s website. You also agree that any modification
to the SEVEN Manuals will not terminate or otherwise alter the effectiveness
of this Agreement.
4.3 You will not distribute, display, sponsor or promote any materials including
or alluding in any manner to sexual, obscene or indecent material, illegal
activities, lotteries, gambling, or any material that Score Entertainment,
in its sole discretion, deems distasteful, vulgar or demeaning.
4.4 You are not an agent of Score Entertainment, you will not represent yourself
to third parties as Score Entertainment’s agent, and you will immediately
rectify any belief by a third party that you are an agent of Score Entertainment
upon discovery of the misunderstanding.
4.5 You understand that the registered Hosts and Judges of the SEVEN community
are not agents or representatives of Score Entertainment.
4.6 Score Entertainment is entitled to make the final rule determination
in disputes arising out of SEVEN approved events.
5.0 Participant Actions. All Hosts, Judges, Players, and On-Line Users participating
in any SEVEN approved event or on-line forum are acting on their own
behalf, and they have no authority to speak or act on behalf of Score Entertainment.
Score Entertainment does not approve, consent or endorse any action by a Host,
Judge, Player or On-Line User in connection with a SEVEN approved
event or on-line forum.

officers, directors, shareholders, employees, insurers, agents and representatives
(collectively, the “released parties”), from any and all liabilityfor
personal injury or property damage, including any special, incidental or consequential
damages, arising out of, or occasioned by, directly or indirectly, your participation
in any Score Entertainment approved event and agree to hold the released parties
free, clear, and harmless from any and all claims and demands for personal
injury or property damage arising out of, or occasioned by, directly or indirectly,
your participation in any Score Entertainment approved event. These limitations
apply to all causes of action in the aggregate, including without limitation,
breach of contract, negligence, misrepresentation and other torts.
8.0 Waiver of Consumer Rights. You agree to waive your rights under
the Texas Deceptive Trade Practices-Consumer Protection Act, Section 17.41
et seq., Texas Business & Commerce Code, a law that gives consumers special
rights and protections. You have had the opportunity to consult with an attorney
of your own selection and voluntarily consent to this waiver.
9.0 Entire Agreement. This Agreement constitutes the entire understanding
and agreement of you and Score Entertainment (collectively, “Parties”)
as to the matters set forth herein. No alteration of or amendment to this Agreement
shall be effective unless made in writing and signed by each of the Parties
hereto.
10.0 Governing Law. This Agreement will be governed by and construed in accordance
with the laws of the State of Texas without regard to its rules on choice of
law.
11.0 Venue and Forum Selection. The Parties agree that this Agreement is
performable in Tarrant County, Texas and any and all disputes arising out of
this Agreement shall be brought exclusively in a court of competent jurisdiction
in Tarrant County, Texas.

may change their addresses if notice of such change is delivered in writing
to the other party.
